At a Continued Meeting of the Nelson County Board of Supervisors on
April 19, 2005, 6:15 p.m., at the Courthouse in Lovingston, Virginia,
thereof:

Agenda Item Number I. Call Meeting to Order
Supervisor Wood called the meeting to order at 6:15 p.m.
Agenda Item Number II. Review of Zoning Ordinance
The Board of Supervisors continued review of the Zoning Ordinance as follows:
Rural & Farming District, R-F
The Family Subdivision minimum lot size was changed to one acre with a two year requirement.
Building Height: The Residential Building Height was changed from
forty-five feet to thirty-five feet, with public or semi-public
buildings at forty-five feet; cupolas, spires and steeples were changed
to seventy-five feet with a Special Use Permit; and accessory and farm
buildings were changed to fifty feet.
Minimum Setback Requirements were changed to the following:Å6¶5Front
Yard: Thirty-Five feet if road is wider than fifty feet or
fifty-five feet if road is less than fifty feet wide.
Side Yard: Ten feet from the property line and the total width of
the two required side yards shall be twenty-five feet or more.
Rear Yard: Twenty-five feet or more.
Minimum Lot Width: One hundred twenty-five feet at road frontage.
Additionally, the Board of Supervisors changed the requirements for
structures other than residential dwellings (accessory uses and
structures) to a maximum percentage of the lot coverage equal to
fifteen percent.
Discussion of the Landscape and Screening and Parking and Loading
Requirements in the Residential Farming District was tabled until
further review of the proposed chapters.
Staff was directed to change the requirements for the public
subdivision and private street and driveway standards to reference
county and VDOT requirements.
Rural Residential District:
Permitted Uses: The use was changed from single-family detached and manufactured homes to include duplex structures.
Uses Permitted by Special Use Permit: Sawmill, temporary and
permanent was deleted as a use; dog kennel was changed to private,
one-commercial dog kennel; deleted livestock sales facility; and added
self-storage units and small entrepreneurial enterprises.
Added a requirement for the application for a higher density, stating
that the applicant must demonstrate that such development will not
conflict with any of the County°Øs farming, rural preservation and
conservation objectives.
Maximum R-R Density:
The following changes were made:
Fifteen acre tract: One lot per five acres for a total of five development rights (minimum lot size is two acres).
Twenty-five acre tract: One lot per five acres for a total of five development rights (minimum lot size is two acres).
Maximum of ten development rights on forty acres.
Additionally, Staff was directed to rework the rest of the chapter based on the densities above.
Agenda Item Number III. Other Matters
Re: Acceptance of Deed of Gift by Nelson County for the Virginia Blue Ridge Railway Trail
On a motion duly made by Mr. Bruguiere, seconded by Ms. Brennan, with
Mr. Bruguiere voting yes, Ms. Brennan voting yes, Mr. Harvey voting
yes, Mr. Harris voting yes, and Mr. Wood voting yes, the following
Resolution was adopted:
BE IT RESOLVED, By the Board of Supervisors of the County of Nelson,
Virginia, that said Board hereby accepts property by deed of gift, the
metes and bounds of which are described in said deed of gift, as
conveyed to Nelson County, as Grantee, by Stephen C. Martin and Mary
Porter Martin, as Grantors, with the expressed condition and covenant
of the conveyance being:
1. The use of the property so conveyed shall be as a
public trail for non-motorized uses of hiking, jogging, horseback
riding and cross county skiing.
2. The conveyance is made subject to all valid
reservations, restrictions, conditions and easements of record which
are now binding upon said property but do not impair its marketable
title.
3. Acceptance of the deed is made with
acknowledgement by Nelson County that the deed was prepared without a
title examination of the subject property.
BE IT FURTHER RESOLVED, By the Board of Supervisors of the County of
Nelson, Virginia, that the Chairman of said Board and the Attorney for
said County are hereby authorized to execute the Deed of Gift on behalf
of Nelson County.
Agenda Item Number IV. Adjournment
The Board of Supervisors scheduled the next meeting for Thursday, April
21, 2005, 7:00 p.m., in order to conduct a budget work session.

On a motion by Mr. Harvey, seconded by Mr. Bruguiere, with Mr. Harvey
voting yes, Mr. Bruguiere voting yes, Ms. Brennan voting yes, Mr.
Harris voting yes, and Mr. Wood voting yes, the following Resolution
was adopted:
BE IT RESOLVED, That the Nelson County Board of Supervisors does hereby
continue the April 19, 2005 Meeting to April 21, 2005, 7:00 p.m., in
order to conduct a budget work session.
