At a Continued Meeting of the Nelson County Board of Supervisors on May
23, 2005, 6:00 p.m., at the Courthouse in Lovingston, Virginia, thereof:

Agenda Item Number 1. Call Meeting to Order
Supervisor Wood called the meeting to order.
Agenda Item Number II. Piney River III Project
Mr. Carter stated that grants are not available for the water portion
of the Piney River III Project without an increase in the monthly
service rate. Rural Development’s formula requires that the
county increase the rate to the state average of $29.00. Mr.
Carter also stated that staff has recommended that the rate be changed
to $26.00 for the first 4,000 gallons used and $6.10 for each 1,000
gallons over 4,000. The average household uses 4,500 gallons per month
and the $6.10 rate can be prorated for less than 1,000 gallons used.
Mr. Carter further stated that the Board cannot establish rates for the
Service Authority and that the proposed rate would be for the Piney
River III Project.
Additionally, Mr. Carter stated that a questionnaire will be mailed to
the households involved in the project listing the monthly rates and
asking which households want the service. The results should be
available by mid-July.
Concluding discussion, on a motion by Mr. Bruguiere, seconded by Mr.
Harvey, with Mr. Bruguiere voting yes, Mr. Harvey voting yes, Ms.
Brennan voting yes, and Mr. Wood voting yes, the Board of Supervisors
directed Mr. Carter to prepare a proposed amendment to the ordinance to
reflect changes to the rate structure.
Agenda Item Number III. Region 2000 Regional Solid Waste Management Study
Mr. Carter discussed participation in the second phase of the Region
2000 Regional Solid Waste Management Study. Nelson’s local cost
to participate is $13,200. Amherst, Campbell, Bedford City and
Lynchburg City have agreed to participate in the Study. Bedford
and Appomattox Counties are considering participation.
Participation in the regional solid waste program could save Nelson
County $2 million over a 10-15 year period.
Concluding discussion, on a motion by Mr. Harvey, seconded by Mr.
Bruguiere, with Mr. Harvey voting yes, Mr. Bruguiere voting yes, Ms.
Brennan voting yes, and Mr. Wood voting yes, the Board of Supervisors
voted to participate in the second phase of the Region 2000 Regional
Solid Waste Management Study and approved an expenditure of $13,200 for
Nelson’s local cost.

Agenda Item Number IV. Zoning Ordinance Work Session
The Board of Supervisors continued a work session on the Zoning Ordinance as follows:
Chapter 3.E: Business District (B-1):
The following uses by right were added to the Zoning Ordinance as follows:
Home Occupation; Golf Driving Range and Miniature Golf; Crematorium; Cemeteries; Sales of New & Used Cars.
Setback requirements for the district were established for corner
commercial and residential lots at 25' front and side yards; the
minimum lot area with public water and sewer were set at one acre and
with well and/or septic at two acres.
The landscape open space requirement was changed from ten percent of
the gross site area to five percent.
The requirement that all B-1 District uses be conducted within the
principal structure to be completed was deleted. The requirement for a
20' landscaped buffer along the property frontage was also deleted.

On a motion by Mr. Harvey, seconded by Mr. Bruguiere, with Mr. Harvey
voting yes, Mr. Bruguiere voting yes, Ms. Brennan voting yes, Mr.
Harris voting yes, and Mr. Wood voting yes, the Board of Supervisors
continued the May 23, 2005 Meeting to Thursday, June 9th at 6:00 p.m.
in order to conduct another Zoning Work Session.
