At a Continued Meeting of the Nelson County Board of Supervisors on
June 9, 2005, 6:00 p.m., at the Courthouse in Lovingston, Virginia,
thereof:
Present: Gary E. Wood, Chair
Harry S. Harris, Vice Chair
Constance Brennan, Central District Supervisor
Thomas H. Bruguiere, Jr., West District Supervisor
Thomas D. Harvey, North District Supervisor
Stephen A. Carter, County Administrator
Fred M. Boger, Planning Director
Agenda Item Number I. Call Meeting to Order
Supervisor Wood called the meeting to order.
Agenda Item Number II. Zoning Ordinance Work Session
The Board of Supervisors continued the Zoning Ordinance Work Session as follows:
Automobile Graveyards:
The Board of Supervisors reviewed proposed changes and recommendations
to the Section on Automobile Graveyards. Additional discussion
was deferred.
Light Industrial District:
The Board of Supervisors changed the minimum site improvements to
include public or private water and sewer service and public or private
road frontage. Hotels and Motels as a Use Permitted by Special
Use Permit were added.
Mr. Boger was directed to contact the County Attorney regarding clarification on Prohibited Uses.
Concluding discussion, the Board stated that the Zoning Ordinance Work
Session will begin with discussion on Light Industrial District Bulk
Regulations.

Agenda Item Number III. Other Matters
A. Economic Development Work Session
The Board of Supervisors scheduled a Work Session with the Economic
Development Authority and Bob DeMauri of the Thomas Jefferson
Partnership for Economic Development on Thursday, June 16th, 3:00 p.m.
B. Solid Waste Collection Sites
Supervisor Harris stated that a possible site in Shipman has been
located for a solid waste collection site and preliminary plans should
be submitted to the Board at the June 14th Meeting.
C. Closed Session
Re: Closed Session
On a motion by Ms. Brennan, seconded by Mr. Bruguiere, with Ms. Brennan
voting yes, Mr. Bruguiere voting yes, Mr. Harvey voting yes, Mr. Harris
voting yes, and Mr. Wood voting yes, the Board of Supervisors went into
Closed Session to consult with legal counsel regarding actual
litigation Pursuant to Section 2.2-3711.A-7 of the Code of Virginia,
1950.
Re: Return to Regular Session
On a motion by Mr. Harvey, seconded by Mr. Harris, with Mr. Harvey
voting yes, Mr. Harris voting yes, Mr. Bruguiere voting yes, Ms.
Brennan voting yes, and Mr. Wood voting yes, the Board of Supervisors
returned to Regular Session.
Re: Certification of Closed Session
On a motion by Ms. Brennan, seconded by Mr. Bruguiere, with Ms. Brennan
voting yes, Mr. Bruguiere voting yes, Mr. Harvey voting yes, Mr. Harris
voting yes, and Mr. Wood voting yes, the Board of Supervisors, Pursuant
to Section 2.2-3712.D of the Code of VA, 1950, that the Nelson County
Board of Supervisors certify that to the best of each member’s
knowledge (i) only public business matters lawfully exempted from open
meeting requirements under Chapter 37 (Virginia Freedom of Information
Act), of Title 2.2 of the Code of VA, 1950 and (ii) only such
public business matters as were identified in the motion by which the
closed meeting was convened were heard, discussed or considered in the
meeting by the public body.

D. Schedule Zoning Ordinance Work Sessions
The Board of Supervisors scheduled Tuesday, June 21st and Thursday, June 30th for Zoning Work Sessions, beginning at 6:00 p.m.

Re: Adjournment
On a motion made by Mr. Harvey, seconded by Mr. Harris, with Mr. Harvey
voting yes, Mr. Harris voting yes, Mr. Bruguiere voting yes, Ms.
Brennan voting yes, and Mr. Wood voting yes, the Board of Supervisors
adjourned the June 9, 2005 Meeting.
