At a Continued Meeting of the Nelson County Board of Supervisors on
November 21, 2005, 6:00 p.m., at the Courthouse in Lovingston,
Virginia, thereof:

Agenda Item Number 1. Call Meeting to Order
Supervisor Wood called the Meeting to order.
Agenda Item Number II. Zoning Ordinance Work Session
A Zoning Ordinance Work Session was conducted as follows:
Chapter 12: Site Plan Requirements and Land Development Criteria
3. Sidewalks and Pedestrian Walkways
The requirement “When an individual lot or property which does not
involve a public street is developed, additional right-of-way to
provide for future bicycle facilities shall be dedicated as recommended
by the Planning Director” was deleted.
K. Final Site Plan Review and Approval Procedures
2. Initial Site Plan Compliance Requirements for Final Site Plan
C. The requirement that the Planning Director notify
the applicant of a rejection due to lack of required information was
changed from five working days to ten working days.

3. Review Procedures for Final Site Plans:
A. Review Process, General
Mr. Boger was directed to consult with the County Attorney to verify
that the Final Site Plan can be approved by the Planning Director
without the Planning Commission conducting a Public Hearing.
Q. Appeals:
2. The time period for an applicant to file an appeal on a Planning
Commission decision was changed from ten calendar days to thirty
calendar days.
Chapter 13, Board of Zoning Appeals
G. Special Exceptions
Directed that G. Special Exceptions be included with the Section on
Variances since the Board of Zoning Appeals does not have the power to
grant Special Exceptions.
H. Consideration of Conditions for Approval
Section H. was deleted.
Chapter 14, Planning Commission
Deleted the language “As covered under State Code.”
Chapter 15. Communication Towers Regulations
Mr. Boger was directed to rewrite the Class I Section to allow a tower
of a given height above the tree line with pre-weathered metal poles
allowed in addition to the current wooden poles.
Chapter 16. Definitions
The Board stated that any definitions they have identified for
inclusion in the proposed Ordinance will be submitted to Mr. Boger.
The Board stated that they will return to some Chapters for further
review since a review of the entire Ordinance has been completed.
Additionally, the Board directed Mr. Boger to change the designation “Town Center” to “Village Center.”

Agenda Item Number III. Other Matters
Supervisor Harvey recommended reconsideration of Ms. Peggy Roberts’
claim for $400 in compensation for livestock destroyed by
canines. Mr. Harvey stated that after discussing the issue with
Ms. Roberts, he no longer believes she knows the owner of the dogs and
that the County did a poor job of investigating the claim.
Concluding discussion, on a motion by Mr. Harvey, seconded by Mr.
Bruguiere, with Mr. Harvey voting yes, Mr. Bruguiere voting yes, Mr.
Harris voting yes, Ms. Brennan voting yes, and Mr. Wood voting no, the
Board of Supervisors voted to compensate Ms. Roberts $400 for the claim.
Additionally, Supervisor Bruguiere stated that the Fleetwood Community
Center will be requesting funding ($5,000) for repairs to the furnace.
The Board discussed setting some standards for assistance to insure all community centers are treated fairly.
The request was deferred until a written request is submitted from Fleetwood.
Agenda Item Number IV. Adjournment
On a motion by Mr. Harris, seconded by Mr. Harvey, with Mr. Harris
voting yes, Mr. Harvey voting yes, Mr. Bruguiere voting yes, Ms.
Brennan voting yes, and Mr. Wood voting yes, the Board of
Supervisors continued the November 21, 2005 Meeting to November 29,
2005, 6:00 p.m.
