At a Continued Meeting of the Nelson County Board of Supervisors on
October 27, 2005, 6:00 p.m., at the Courthouse in Lovingston, Virginia,
thereof:

Agenda Item Number 1. Call Meeting to Order
Supervisor Harris called the Meeting to order at 6:00 p.m. Upon
arrival of Supervisor Wood, Supervisor Harris relinquished the Chair to
Mr. Wood.
Agenda Item Number II. Review of Zoning Ordinance
The Board of Supervisors continued review of the proposed Zoning Ordinance as follows:
Chapter 12, Site Plan Requirements and Land Development Criteria
C. Uses Requiring a Minor Site Plan
Duplexes and two-family residential dwellings were exempted from the
requirement for a minor site plan as well as single-family residential
dwellings.
Section O, Single-Family Residential Lot Plans, was moved to the front
of the chapter in order to clarify the requirements and exemptions.
Site plans for parking areas pertaining to renting a bedroom for single-family residential dwellings were exempted.
D. Uses Requiring a Major Site Plan
The definition of a “Mobile Home Park” was changed from “any area of
twenty acres or more, however designated, that is occupied or designed
for occupancy by one or more manufactured homes.” The term
“Mobile Home Park” shall not include sales lots on which unoccupied
mobile homes, whether new or used, are parked for the purposes of
inspection and sale” was added to the existing Zoning Ordinance
definition that more than two mobile homes constitute a mobile home
park, regardless of the lot acreage.
Concluding a review of D, the Board stated they would continue
discussion on Page 283, 4, Additional Required Supporting Information,
at the next Zoning Ordinance Work Session.
Agenda Item Number III. 7:30 P.M., Public Hearing: 2005 Transportation Enhancement Program
(A) Overview and Resolution: Lovingston Revitalization Program
Mr. Carter stated that a Public Hearing has been scheduled to consider
and receive public comment on projects for submission to the Virginia
Department of Transportation for funding assistance from the
Department’s Transportation Enhancement Program.
Currently, Mr. Carter stated that the Board of Supervisors will
consider the submission of applications to VDOT for enhancement program
funding of the following projects: the Lovingston Revitalization
Project, Oakland – The Nelson County Museum of History, the Blue Ridge
Tunnel Restoration, the Blue Ridge Railway Trail, the Oak Ridge Train
Station and Amenities and Owens Creek Aqueduct.
Concluding comments from Mr. Carter, Bill Mednick with Land Planning
& Design Associates presented a power point presentation on the
Lovingston Revitalization Project.
Mr. Mednick stated that the Project consists of three phases.
Phase 1A, Front Street/Main Street Intersection: Bulbouts at
intersection corners to define parking and reduce crossing widths, new
sidewalks and curb ramps, street lights, street furniture, and a
landscaped pocket park.
Grant Application for Phase I of the Project is $348,000, with a twenty percent County match of $87,000.
Phase 1B. Main Street: Curb and gutter, five feet sidewalks
on both sides of the road, lighting, street trees, and pavement
markings.
Phase 1C. Main Street/Route 29 Intersection: Pedestrian
crosswalks and islands, landscaping, sidewalk connects to Main Street,
and gateway signage.
Additionally, Mr. Carter stated that $74,000 in VDOT surplus secondary
road funds can be applied to Phase I of the Project. Mr. Carter
also stated that the County is proposing to submit an application for
CDBG funds next year and possibly Rural Development funding to generate
business development in the project area.
Concluding comments from Mr. Carter, Supervisor Bruguiere questioned
how does one project affect other projects competing for funding when
there are several projects.
Mr. Carter noted that the Blue Ridge Tunnel Project is now available
for funding in a Statewide funding pool, and that Project will not be
competing for regional funding. Mr. Carter also noted that other
County Projects and Jurisdictions will be competing for the same pool
of funding.
Supervisors Brennan and Harris stated they are pleased with the Lovingston Revitalization Project moving forward.
Supervisor Wood opened the Public Hearing.
There being no comments from the Public, Supervisor Wood closed the Public Hearing.
On a motion by Mr. Harris, seconded by Ms. Brennan, with Mr. Harris
voting yes, Ms. Brennan voting yes, Mr. Bruguiere voting yes, Mr.
Harvey voting yes, and Mr. Wood voting yes, the following Resolution
was adopted:
RE: Project Endorsement, Lovingston Revitalization Project
WHEREAS, In accordance with the Commonwealth Transportation Board
construction allocation procedures, it is necessary that a request by
resolution be received from the local government or state agency in
order that the Virginia Department of Transportation program a
transportation enhancement project in the County of Nelson; and
WHEREAS, Lovingston residents have expressed a resounding desire for
improvements to their Village. This has included a desire for a balance
between increased business opportunities, safe transportation,
affordable housing opportunities and recreation. The Lovingston
Revitalization project envisions a vibrant village environment that
facilitates community, recreation and commerce in a safe and attractive
environment; and
WHEREAS, the first Phase in the Downtown Revitalization Plan will focus
on pedestrian and gateway improvements along the Main Street Corridor
leading from US Route 29 gateway to the Government Center. In order to
create achievable construction and budget goals this first phase is
divided into three parts. In summary, Phase 1 – A will focus on
enhancements to the Front and Main Street intersection. Phase 1 –
B will include pedestrian improvements along Main Street and Phase 1 –
C will focus on re-design and improvements to the Main Street/Route 29
intersection;
NOW THEREFORE, BE IT RESOLVED, That the Nelson County Board of
Supervisors, requests the Commonwealth Transportation Board to
establish funding for the Lovingston Revitalization Project; and
BE IT FURTHER RESOLVED, That the Nelson County Board of Supervisors
hereby agrees to pay a minimum twenty percent of the total cost for
planning and design, right of way, and construction of this project,
and that, if the Nelson County Board of Supervisors subsequently elects
to cancel this project, the Nelson County Board of Supervisors hereby
agrees to reimburse the Virginia Department of Transportation for the
total amount of the costs expended by the Department through the date
the Department is notified of such cancellation.
Agenda Item Number IV. Other Matters
(A) Resolution: Property Acquisition
The Board of Supervisors deferred the proposed Resolution on Property Acquisition until the November 11, 2005 Meeting.
(B) Schedule Six Year Secondary Plan Work Session
The Board scheduled a Work Session on the Six Year Secondary Plan for
Wednesday, November 9, 2005, 6:00 p.m. A Work Session on the
Zoning Ordinance was scheduled for 7:00 p.m. on Wednesday, November 9,
2005.
Additionally, Supervisor Bruguiere discussed an inquiry from residents
in the Piney River area regarding free hook-ups for the Phase III Piney
River Project.
Mr. Carter gave a brief overview of the Project and stated he would
provide an update at the November 8, 2005 Meeting following a meeting
with Engineers Draper Aden & Associates.
Supervisor Wood stated that he will be contacting the Board Members
regarding the County Administrator’s evaluation between now and the
November 8th Meeting.

voting yes, Mr. Harvey voting yes, Mr. Bruguiere voting yes, Ms.

BE IT RESOLVED, That the Nelson County Board of Supervisors does hereby
adjourn the October 27, 2005 Meeting to November 8, 2005, 2:00 p.m.
