June 4, 2007 - Meeting Minutes
Minutes of the third meeting of the Nelson County Bio-Solids Advisory Committee conducted on June 4, 2007 at 3:30 p.m. in the Boardroom located in the Nelson County Courthouse are as follows:
I. Call to Order - The meeting was called to order by Mr. Tommy Bruguiere, Chairman, of the Nelson County Board of Supervisors. Members present included: Tom Eick (Nelson County Health Department), Tim Castillo (Nelson County Service Authority), Hughes Swain (Nelson County Farm Bureau), Phil Payne (Nelson County Attorney), Peter Agelasto (Citizen Representative), Thomas Burnett, Jr. (Citizen Representative) and Steve Carter (County Administrator). Gary Scott (Citizen Representative and Chairman of Nelson Citizens Against Toxic Sludge) was absent due to personal business.
II. Minutes of April 19, 2007 Meeting - The minutes of the Committee’s meeting on April 19, 2007 were submitted but not formally considered by the Committee.
III. Draft Ordinance – Mr. Payne discussed provisions of a draft local ordinance that his office had prepared for the Committee’s consideration. In discussion, Mr. Agelasto asked about establishment of setback regulations that are more restrictive than state regulations should the state law be changed to provide local governments with this ability. It was agreed that a local biosolids ordinance in effect at such time would have to be formally amended to incorporate more rigid setback requirements than established in state regulations. The Committee discussed and agreed that the draft local ordinance should contain a provision requiring notice by the County to adjacent landowners (i.e. contiguous properties) of its receipt from state agencies of biosolids applications submitted for properties located in Nelson County. And, the Committee membership agreed that the enforcement provision contained in the model ordinance previously developed by the Virginia Association of Counties and Virginia Municipal League should be included in the biosolids ordinance the Committee is completing (i.e. “The County may bring suit to enjoin, restrain, correct or prevent any violation of this ordinance”).
IV. Next Steps - The Committee members agreed that following Mr. Payne’s completion of revisions discussed at today’s meeting that the revised draft ordinance would be distributed to the members by email for review and input prior to submission to the Board of Supervisors, including the possible conduct of another meeting prior to the ordinance being provided to the Board for review and formal consideration. Messrs. Payne and Carter to coordinate.
