NELSON COUNTY PLANNING COMMISSION
MEETING MINUTES
July 26, 2006


Present: Chair Philippa Proulx, Commissioners Linda Russell, Emily Hunt, Dolores Truesdale and Michael Harman, and Supervisor/Commissioner Thomas Bruguiere

Staff Present:  Planning Director Fred Boger and Secretary Betty Fortune

Call to Order:  Chair Proulx called the meeting to order at 7:30 P. M. in the Board of Supervisors meeting room of the County Courthouse.  Chair Proulx announced that the Conditional Use Permit which was advertised for Mr. Cecil Truslow has been removed from the agenda.

Approval of Minutes:  
Minutes from the June 28, 2006 Planning Commission meeting were reviewed with no changes made.  Commissioner Hunt made a motion to approve the minutes, Commissioner Russell provided the second, and motion passed 5-0.

Final Site Plan #2006-005 – RoseWood Village at Wintergreen

Mr. Boger reported that Mr. Shareef Tahboub and Ms. Virginia Tahboub have submitted the final plan for Phase 1, RoseWood Village at Stoney Creek, which is an amendment to the Wintergreen Master Plan.  The site plan contains information on the proposed location of 25 patio homes, roads, utilities, fire hydrants, and the site’s topographic detail.  A wetlands exhibit was also submitted.  The entrance by the Valley Emergency Services facility will need to be upgraded to comply with VDOT’s residential entrance requirements.  Alyson Sappington of Thomas Jefferson Water & Soil Conservation District has notified the Planning Department that long-term stormwater planning was completed and approved with the Stone Orchard plan.  The short-term temporary E & S plan will be submitted by Mr. Jensen by the end of the current week and no problems are anticipated, according to Ms. Sappington.  Mr. Boger stated that the applicant has been advised to review Sections 7-3-2 and 7-3-3 of the zoning ordinance which reference open space and recreational items when application is made for the next phase.  Staff has identified no problem with the final plan and recommends approval.  Mr. Boger complimented the Tahboubs for submitting a complete and comprehensive plan.

Ms. Tahboub was present and presented letters from Wintergreen Resort (Mr. Bob Ashton of WPI) and Wintergreen Property Owners’ Association, Inc. (Mr. Russell Otis) in support of the project.  

The public hearing was opened, there were no comments, and public hearing was closed.

Commissioner Russell made a motion to approve the site plan, as stated in the following Resolution:

The Planning Commission approves Site Plan #2006-005 for RoseWood Village at Wintergreen for 25 patio homes to be located on Monocan Drive, Nellysford,

as shown on Phase 1 Master Plan dated June 23, 2006, subject to final approval of short-term E & S plan and verification that the entrance by Valley Emergency Services facility has been brought up to VDOT standards.

Commissioner Harman provided the second, and motion passed 6-0.  

Final Subdivision Plat – RoseWood Village at Wintergreen

Mr. Boger reported that Mr. Shareef Tahboub and Ms. Virginia Tahboub have submitted the final subdivision plat for Phase 1 of Rosewood Village at Wintergreen, consisting of 25 subdivision lots and 2 additional lots for future development..  The site is located on the south side of Monocan Drive adjacent to the former Tuckahoe School.  The plat appears to be completed with the exception of setback lines which are shown on final site plan.  E & S and Stormwater Management Plan will be submitted to Ms. Sappington to verify that the existing system can handle the increase in water.  Staff recommends approval of the plan.

Ms. Tahboub was present.

Commissioner Russell asked if the PC needs to recommend to the Board of Supervisors approval of an exception to the 50’ road easement requirement.  Mr. Boger said this was done as part of the Wintergreen Master Plan approval for Stone Orchard.  Commissioner Russell was of the opinion that the exception was for Stone Orchard only.  Ms. Tahboub and Mr. Boger stated that the exception covered both projects.

The public hearing was opened, there were no comments, and public hearing was closed.

Commissioner Russell made a motion to approve the site plan, as stated in the following Resolution:

The Planning Commission recommends to the Board of Supervisors approval of the final subdivision plat dated June 14, 2006, revised June 21, 2006, entitled “Subdivision Plat of RoseWood Village at Stoney Creek, Wintergreen, Nelson County, Virginia.”

Commissioner Hunt provided the second, and motion passed 6-0.  

Preliminary Subdivision  - “The Village” at Glen Mary

Mr. Boger reported that Mr. Morris Foster, Land Surveyor, representing Verd To Go, LLC, has submitted the preliminary subdivision plat to divide an approximate 23.82 acre portion of Tax Map #31-A-48A into six lots.  This project is the commercial section of the Glen Mary development.  The residential subdivision portion was previously approved by the PC.  The proposed lot usage may be:  Lot 1 – restaurant and micro-brewery, lot 2 – bank, lot 3 – 6-bay retail building with 4 apartments above, lot 4 – grocery-type store, lot 5 – 4-bay retail with 4 apartments above, lot 6 – recreation area.  Mr. Foster is working with FEMA to determine how much of the site is within the 100-year floodplain.  Each lot will be served by individual well and septic system.  Each lot will front on either Rt. 151 or Rt. 664.  Mr. Boger has made the interpretation that the internal roads are considered private driveways.  In SE-1, the required setback is 75’ from the road.  A center court will be used for parking, recreation, and stormwater management.

Chair Proulx asked why the internal roads were labeled private driveways.  Mr. Boger said that each one opens to a separate driveway which is considered a private driveway.  They will be entering with an 80’ easement as well as separate lots.  Ms. Russell said she would like to see a 50’ access road if two-way.  If one-way, 40’ may be sufficient.  Mr. Boger said the internal roads will need to be addressed on the site plan, and Commissioner Russell felt the developer should know about concerns any PC member might have  prior to the completion of the site plan.

Mr. Foster said there has been no change in the project concept since the original rezoning for the adjacent residential subdivision.  Potential clients want to buy the lots rather than lease.  The road plan has changed and the subdivision created to meet all present zoning ordinance requirements.  A master site plan will be developed in the near future.  The main entrance on Rt. 664 is a safe one with sufficient sight distance.  There will likely be two roads – one will be one-way into the business area and one to be used as a service road and for apartment parking.  All roads will be paved in some fashion, i.e. cobblestone, asphalt, etc..  Ms. Russell said she would like to see a 50’ easement for roads used by delivery trucks, etc.  Mr. Foster said the easement is irrelevant – the width of the road is important.  

The public hearing was opened, there were no comments, and public hearing was closed.

Chair Proulx stated her understanding is that apartments are not permitted in SE-1 - only single family and two-family dwellings (duplex).  Mr. Foster will consult with the developer concerning this.

Commissioner Russell, made a motion to approve the site plan, as stated in the following Resolution:

The Planning Commission approves the preliminary subdivision plat for “The Village” at Glen Mary, identified as Tax Map #31-A-48A, dividing 23.82 acres into 6 lots, as shown on the plat titled “Preliminary Plan – ‘The Village’ at Glen Mary dated 6/02/06, revised 7/24/06.

Commissioner Harman provided the second, and motion passed 6-0.  

Other Business

Supervisor liaison, Thomas Bruguiere, reported that the Board approved all items sent to them from the PC last month.  

Chair Proulx asked Supervisor/Commissioner Bruguiere why he voted against reappointment of  Commissioner Russell, Hunt and herself at the July meeting.  Mr. Bruguiere stated that the Board felt more time was needed for other applicants to respond.  It is anticipated that appointments will be made in September.

Commissioners again expressed a desire to know the purpose and topics to be discussed at the proposed joint meeting with BOS which is tentatively set for September.  Supervisor/Commissioner Bruguiere will discuss this with the BOS Chair in August.

WHEREAS, Mr. Shareef Tahboub has requested approval of Site Plan #2006-005 for RoseWood Village at Wintergreen for the villa portion (Phase 1) which will consist of 25 patio homes located on Monocan Drive, Nellysford, adjacent to Tuckahoe School and identified as Tax Map #22-A-9; and

WHEREAS, a notice of Public Hearing for the review of the site plan by the Nelson County Planning Commission was published in the Nelson County Times on July 6 and 13, 2006; and

WHEREAS, on July 14, 2006, adjoining property owners were notified of the public hearing on this application; and

WHEREAS, on July 26, 2006, the Nelson County Planning Commission held the required public hearing on said site plan; and

NOW, THEREFORE, BE IT RESOLVED BY THE NELSON COUNTY PLANNING COMMISSION as follows:

WHEREAS, Mr. Shareef Tahboub has filed a final subdivision plat with the Nelson County Planning Department  to divide 13.53 acres into twenty-five subdivision lots and 2 additional lots for future development, to be known as “RoseWood Village” located on Monocan Drive, Nellysford, identified as Tax Map #22-A-9; and

WHEREAS, a notice of Public Hearing for the review of the final plat by the Nelson County Planning Commission was published in the Nelson County Times on July 6 and 13, 2006; and

WHEREAS, on July 14, 2006, adjoining property owners were notified of the public hearing on this plat; and

WHEREAS, on July 26, 2006, the Nelson County Planning Commission held the required public hearing on said final plat; and

NOW, THEREFORE, BE IT RESOLVED BY THE NELSON COUNTY PLANNING COMMISSION as follows:

WHEREAS, Steve Crandall of Verd To Go, LLC has requested approval of a preliminary subdivision plat for “The Village” at Glen Mary, for a division of 23.82 acres to be divided into 6 lots ranging in size from 2.0 acres to 5.6 acres, located on Patrick Henry Highway and Beech Grove Road, Roseland; and

WHEREAS, a notice of Public Hearing for the review of the subdivision by the Nelson County Planning Commission was published in the Nelson County Times on July 6 and 13, 2006; and

WHEREAS, on July 14, 2006, adjoining property owners were notified of the public hearing on this application; and

WHEREAS, on July 26, 2006, the Nelson County Planning Commission held the required public hearing on said preliminary subdivision plat; and

NOW, THEREFORE, BE IT RESOLVED BY THE NELSON COUNTY PLANNING COMMISSION as follows:
