NELSON COUNTY PLANNING COMMISSION
MEETING MINUTES
December 7, 2006


Present: Chair Philippa Proulx, Commissioners Linda Russell, Emily Hunt,  Dolores Truesdale, and Supervisor Tommy Bruguiere

Absent:  Commissioner Michael Harman

Staff Present:  Planning Director Fred Boger and Secretary Betty Fortune

Call to Order:  Chair Proulx called the zoning ordinance workshop to order at 7:30 P. M. in the Board of Supervisors meeting room of the County Courthouse.  The purpose of the meeting is to review zoning ordinance and subdivision amendments.  

Subdivision Ordinance Amendment Discussion

The Subdivision Ordinance amendments were reviewed with clarification made on the process for submitting the preliminary and final subdivision plats.  The Commission will review either plat after they have had a complete administrative review and are considered to be an official submission.  

Chair Proulx asked whether the 60-day action requirement could be extended to 65 days.  She will check the State code and advise.

Zoning Ordinance Amendment Discussion

The following items were added/changed/omitted:
1)    Article 2. Definitions – Horticulture – herbs and mushrooms were added to the definition.
2)    Article 3. Conservation District C-1 – Side yard – lots greater than 5 acres in size:  Three hundred (300) feet from the property line (added) on each side.
3)    Article 4.  Agricultural District A-1 – Uses – Permitted by Conditional Use Permit only – Motels, (added) hotels.
4)    Article 4.  Agricultural District A-1 – Section 4-11-3 – Temporary events.  Added from the existing ordinance:  The Zoning Administrator may attach such specific conditions to the issuance of the temporary permit as he deems necessary to minimize the potential adverse impact on the surrounding area or general public.
5)    Article 21.  Cluster Housing Development, Section 21.1 Purpose – This section offers the option of creating subdivisions consisting of clusters of small lots and open space by right in Conservation C-1, Agricultural A-1 and Residential R-1 districts.  Cluster developments are intended to preserve rural character, reduce the amount of land consumed by development, and lower the cost of roads and other facilities.
6)    Article 21. Cluster Housing Development, Section 21.2 Area and density – Added Residential R-1 regulations – The minimum area for a cluster development shall be thirty (30) acres.  The overall density of development shall not be greater than one dwelling unit per two (2) acres.  A minimum of forty (40) percent of the land area shall be reserved for agriculture, forestry, recreation and/or open space.
7)    Article 21.  Cluster Housing Development, Section 21.5 Lot standards – The required lot area (square feet) shall be as follows:  1)  Where no public water and sewer are provided:  43,560 per lot (changed from 40,000); 2) Where public sewer is provided:  30,000 minimum, 43,560 maximum per lot (changed from 40,000); and 3)  Where both public water and sewer are provided:  10,000 minimum, 43,560 maximum per lot (changed from 40,000).
8)    Article 21.  Cluster Housing Development, Section 21.5 Lot standards.  Added accessory structure setback:  The minimum setback for an accessory structure will be a minimum of 10 feet from a property line.  An accessory structure shall not be located in the required front yard.
9)    Article 21.  Cluster Housing Development, Section 21.7 Procedure for approval. If the subdivision plat and/or development has a feature(s) requiring approval by a State agency, the Planning Director shall approve or disapprove the plans within thirty-five (35) days upon receipt of the approvals from all Federal, State and local agencies.

At 8:50 P. M. Commissioner Russell made a motion to adjourn, Commissioner Hunt provided the second, and motion passed 5-0.
