MEETING MINUTES
February 28, 2007
Present: Chair Philippa Proulx, Commissioners Linda Russell, Emily Hunt, Michael Harman, Dolores Truesdale and Supervisor Tommy Harvey
Staff Present: Planning Director Fred Boger and Secretary Betty Fortune
Call to Order: Chair Proulx called the meeting to order at 7:30 P. M. in the Board of Supervisors meeting room of the County Courthouse. She announced that upon consultation with County Attorney regarding the requirement for formal roll call, as suggested by Supervisor Harvey at the January meeting, the Planning Commission is not required to have a roll call. Chair Proulx will continue to ask each Commissioner for their decision on each presented application.
Chair Proulx announced that the final subdivision advertised for Paul Mimms will be handled administratively, and consequently does not need to come before the Commission.
Approval of Minutes: Commissioner Hunt made a motion to accept minutes from January 16 public hearing (spelling of “commissioner” corrected), January 18 zoning ordinance workshop, and January 24, 2007 regular meeting. Commissioner Harman provided the second, and motion passed 6-0.
Final Subdivision – Glenn Goldstein (Continued from January meeting)
[In January 2007, Mr. Boger reported that Mr. Goldstein has submitted a final subdivision plat dividing his property identified as Tax Map 19-1, Parcel 5 into three lots. The property is located in the Hickory Ridge Section, Mountain Subdivision 10-B, Wintergreen. The majority of the property is located in Augusta County; however, since a small section is within Nelson County, the County is required to approve the final plat also. The proposed lot will be served by public water and sewer, which is being negotiated with Nelson County Service Authority.]
Chair Proulx announced that the public hearing on this subdivision plat was held in January.
Mr. Boger presented the following additional information based on discussions with Tim Castillo, Executive Director of NCSA:
1) The new sewer line would be dedicated to and owned by the NCSA.
2) The rates and connection fees would be set by the NCSA.
3) All properties along the new sewer line would be required to comply with the requirements adopted by the NCSA and County for connections.
Mr. Goldstein is exploring the possibility of using an alternative sewage system for the new lots.
Chair Proulx confirmed that new residences within 300 ft. of the system would be required to connect. The same requirement would apply if present systems fail. Commissioner Russell asked if rates and connection fees would be different from other County systems and Supervisor Harvey said that rates charged in Wintergreen would apply.
Mr. Stuart Sadler, representing Mr. Goldstein, restated that prior to the January meeting, he was not involved in discussions between Mr. Goldstein and Mr. Castillo. Since then, the three had met. Mr. Goldstein had been under the impression that he would recover his initial cost; however, that was in error. The maximum amount Mr. Goldstein can recover is approximately $25,000 of the estimated initial $250,000 investment. He may decide to install an alternative system for $25,000-$30,000 per lot. Mr. Boger said that if this is the case, the Health Department would need to approve the system.
Commissioner Russell made a motion to recommend approval of the plat to the Board of Supervisors, as stated in the following resolution:
The Planning Commission recommends to the Board of Supervisors approval of the final subdivision plat for Glenn Goldstein for the division of 3.36 acres into 3 lots located in Hickory Ridge Section, Lot 5, Wintergreen, Tax Map #19-1-5, a major portion of which is located in Augusta County, as shown on plat dated 10-4-2006 consisting of 2 pages.
Mr. Harman provided the second, and motion passed 6-0.
Mr. Sadler stated that Augusta County has not taken action on this plat because they are unable to determine if there was ever an approved sewer system for this subdivision. Mr. Sadler will be providing additional information to Augusta County.

Rezoning #2007-003 – Curtis Bruguiere
Mr. Boger reported that Mr. Bruguiere has submitted an application to rezone approximately 1.88 acres located at 1897/1889 Avon Road, Afton, from Resdential R-1 to Agricultural A-1 to allow office space for his real estate business in the building known as Anderson’s Grocery. Mr. Boger related the following history on this request. In February 2002 the applicant submitted a petition to rezone the subject property to Business B-1. The request was withdrawn. Another petition was submitted in April 2005 to rezone the property to Business B-1 (Conditional). The Planning Commission voted to recommend to the BOS denial of this request. The BOS suggested to Mr. Bruguiere that he consider rezoning the property to Agricultural A-1 with a Conditional Use Permit to operate his real estate office in the building. Mr. Bruguiere withdrew his application and did not pursue the option of rezoning to A-1 with a CUP.
Supervisor Harvey withdrew from the discussion since his business is close to Mr. Bruguiere’s present store.
Chair Proulx confirmed with Mr. Bruguiere that he planned to place his real estate office in the Anderson’s Grocery building. Commissioner Russell asked if there is a current survey of the property and Mr. Bruguiere replied that there is not. Commissioner Russell suggested that one be done. She is concerned about the parking and a current survey would better describe the property, identify property lines, VDOT right-of-way, etc.
Mr. Bruguiere said that VDOT changed some setbacks in 1964 when the road was changed years ago. He can provide a copy of that plan, if necessary. With 1.88 acres, there is space to park quite a few cars.
Chair Proulx reiterated that the rezoning request is to allow for an office and that setbacks were not a major concern. Commissioner Russell stated that a new plan would be helpful in light of the fact that Mr. Bruguiere is requesting rezoning to add the real estate office and to bring Anderson’s Grocery into compliance. In 2005, Mr. Bruguiere requested a CUP and agreed by proffer to limit the use to neighborhood convenience store and real estate office. Commissioner Russell asked Mr. Bruguiere if the current application includes a similar proffer and he said there was no proffer. Mr. Boger said that conditions can be placed on a Conditional or Special Use Permit.
Mr. Bruguiere stated that this change would have no effect on the neighborhood as there would be no additional through traffic. He mentioned several examples of recent store renovations which have had a positive effect – Ashley’s Store, Afton Service Center, etc. In his opinion, property values would not be compromised. He said the biggest problem in the neighborhood is unlicensed, inoperable cars and trucks. He added that an expansion of his business could employ additional people from the community.
The public hearing was opened.
Roy White stated that he represented the citizens of Avon Road. He presented several letters from property owners and a petition opposing the rezoning. Mr. White said he heard there was a possibility that Mr. Bruguiere would install gas pumps at the store and it would be a safety hazard due to lack of parking and closeness of the building to the driveway. There is also concern about bright lights on after-hours gas pumps. He indicated that Mr. Bruguiere may have a hidden agenda in asking for conformance for the store. He had a “survey” that was done in 1964 which stated Mr. Bruguiere’s property is 1.5 acres, rather than 1.88 acres. He stated that a new survey is needed, as well as a site plan for the property. Mr. White requested that the neighborhood be left as it is and that the rezoning be denied.
The public hearing was closed.
Commissioner Russell questioned the size of the lot and the store. Mr. Bruguiere showed the Commission a VDOT plan from 1964 and said the store is approximately 1600 square feet with road frontage on Rt. 638 and 151. He stated that if someone were to develop the property, they could eliminate the existing buildings and have adequate space to meet setbacks, build a new building, have adequate parking, etc.
Chair Proulx said that it seems the requested rezoning petition and CUP for office space has changed somewhat and is alarmed that other uses would change the character of the neighborhood. She has no problem with the rezoning and the CUP; however, the property doesn’t meet the requirements for a conforming lot. A site development plan is needed for the Conditional and Special Use Permits to be considered.
Commissioner Harman stated that he originally had no problem with the rezoning and CUP; however, the SUP request places this in a different light. Chair Proulx said the items should be approved or disapproved separately.
Commissioner Russell said it was unclear how many parking spaces were needed, where the VDOT right-of-way is located, and if there is enough space to accommodate all these uses. The Comprehensive Plan showed no further commercial use of this property and she is unable to support any further commercial use since traffic can only increase in this area.
Mr. Boger said that the ordinance doesn’t specify whether a survey can be required; however, the Planning Commission should be able to be confident of what is being rezoned and a current survey would provide the necessary information. The Commission can postpone the decision to request the survey. Mr. Bruguiere agreed that it would be in his best interest to have a survey done.
Commissioner Russell made a motion to defer rezoning application #2007-003 for Curtis Bruguiere until the March meeting, at which time a survey of the property should be presented. Mr. Harman provided the second, and motion passed 5-0-1, with Mr. Harvey abstaining.
Mr. Boger said that if one month is insufficient time to get the survey done, Mr. Bruguiere may contact Mr. Boger for additional time.
Conditional Use Permit #2007-002 – Curtis Bruguiere
In light of the previous deferment of Rezoning #2007-003, Commissioner Russell made a motion to defer CUP request #2007-002 until the March meeting to allow time for additional information to be presented. Mr. Harman provided the second, and motion passed 5-0-1, with Mr. Harvey abstaining.
Special Use Permit #2007-001 – Curtis Bruguiere
In light of the previous deferment of Rezoning #2007-003, Commissioner Russell made a motion to defer SUP request #2007-001 until the March meeting to allow time for additional information to be presented. Mr. Harman provided the second, and motion passed 5-0-1, with Mr. Harvey abstaining.
Chair Proulx stated that these three items for Mr. Bruguiere will be advertised for public hearing in March.
Rezoning #2007-002 – Jerome Chambers
Mr. Boger reported that Mr. Chambers is requesting to rezone 6.88 acres from Industrial M-1 to Agricultural A-1 for the purpose of constructing a residential building on this site for his mother, the owner of the property. The Health Department must approve the septic drain field and well location and AEP contacted for electric service. The property is located on Cold Storage Lane, Tax Map #77-A-4. In 1990 Parcel #3 adjoining Ms. Chambers’ property was rezoned from Industrial to Agricultural A-1.
Mr. Chambers said that the land has been vacant for some time and his mother would like to move here when she retires.
The public hearing was opened.
“Bo” Delk said the Cold Storage property is located very close to the Chambers’ property. M-1 zoned property is becoming scarce and suggested a “caretaker” home could be placed on the property if there is some type of industry there. In his opinion, the land would be more valuable if left in the current zoning.
The public hearing was closed.
Commissioner Harman made a motion to recommend approval of the rezoning application to the Board of Supervisors, as stated in the following resolution:
The Planning Commission recommends to the Board of Supervisors approval of rezoning application #2007-002 for Jerome Chambers to rezone 6.88 acres near Rt. 758, Cold Storage Lane, Arrington, from Limited Industrial M-1 to Agricultural A-1, contingent upon Health Department approval of well and septic provision.
Commissioner Truesdale provided the second, and motion passed 6-0.
Conditional Use Permit #2007-001 – Timothy J. Lacey
Mr. Boger reported that Mr. Lacey has recently purchased 700+ acres on James River Road, built a residence, and would like to construct a 30’ x 1400’ private landing strip with a future hanger/barn on this property identified as Tax Map #80-A-32. Mr. Lacey has consulted UVa medical transport (Pegasus) and they have no problem with this location. He has also talked with the Nelson County Rescue Squad personnel about leasing land to them for construction of a landing pad beside their building. Mr. Lacey met with Mr. Harry Harris who indicated he had no problem with the request.
Commissioner Harman shared with the Commission some 12 conditions that were placed on a private landing strip back in 1977. Many of these conditions are now addressed by other agencies or were specific to that application.
Mr. Lacey stated that he has a private plane and a helicopter for which he will use the landing strip. It is centered on a high ridge, is not visible from surrounding properties, and there are no residences anywhere close. It is 28 miles outside the Pegasus fly zone. The E & S Plan has been approved and no electricity is needed at the site at this time. The plane is for personal use with approximately 4-5 landings per month. Following local government approval, application will be made to the FAA. Very little grading is needed, reducing the loss of mature trees.
The public hearing was opened, there were no comments, and public hearing was closed.
Commissioner Harman made a motion to recommend approval of the rezoning application to the Board of Supervisors, as stated in the following resolution:
The Planning Commission recommends to the Board of Supervisors approval of Conditional Use Permit #2007-001 for Timothy J. Lacey of Black Fox Hills Farm to construct a personal-use 1400’ long, 30’ wide paved airstrip on property located on Rts. 626 and 56, identified as Tax Map #80-A-32.
Commissioner Russell provided the second, and motion passed 6-0.
Final Subdivision – “Wolf Run Subdivision” – Habitat for Humanity/Nelson County Community Development Foundation
Mr. Massie Saunders, Land Surveyor, submitted the final subdivision plat on behalf of H for H and NCCDF for “Wolf Run Subdivision” located on Lobo Lane, Route 734 (Tax Map #77-A-204 & 206), which will divide 39.5 acres into 14 lots ranging in size from 2.0 to 4.8 acres. Soil work has been completed and submitted to the Health Department. The E & S Control Plan has been sent to the TJSWCD office. VDOT has approved the proposed entrance.
Mr. George Krieger of NCCDF stated that roads would be built to VDOT standards.
The public hearing was opened, there were no comments, and public hearing was closed.
Commissioner Russell made a motion to recommend approval of the final subdivision plat to the Board of Supervisors, as stated in the following resolution:
The Planning Commission recommends to the Board of Supervisors approval of the final subdivision plat for Nelson County Community Development Foundation and Nelson County Habitat for Humanity for the division of 41.040 acres into 14 lots located Lobo Lane (Rt. 734), Tax Map #77-A-204 and 77-A-206, subject to final Health Department and E & S approval.
Commissioner Hunt provided the second and motion passed 6-0.
Site Plan #2007-006 – Doug Long
Mr. Boger reported that what Mr. Long has submitted is not an actual site plan, but a grading plan for establishing two (2) sites for potential builders on property located in Callohill Industrial Park, a portion of Tax Map #57-A-34R. The complete site plan will be submitted based on buyer preference at the time of sale. At this time, the Commission just needs to receive this for informational purposes. At this time, water and sewer provision is being addressed as well as stormwater management.
Mr. Saunders said there are several prospective buyers of these building spaces and it is understood that a formal site plan will be submitted when the spaces are sold. There will be two level pads; stoning and grading has been done. The spaces will be served by public water and sewer. The applicant wanted to let the County know of potential locations and solicit comments. No approval is expected at this time. Chair Proulx agreed that this should have been presented as an informational item rather than a public hearing item. Mr. Saunders said he had no problem withdrawing the partial site plan or it could be deferred for 30 days to receive such authorization from Mr. Long.
Since it was advertised as such, the public hearing was opened. There were no comments. Public hearing was closed.
Commissioner Russell made a motion to defer Site plan application #2007-006 submitted by Doug Long for two building pads until the March meeting to await further information on the deferral. Mr. Harman provided the second, and motion passed 6-0.
Site Plan #2007-004 – William Trager
Mr. Boger reported that Mr. Trager has submitted a site plan for an accessory structure to be used in the Business B-1 district for the storage and grinding of coffee. The property is located at 486 Front Street, Lovingston, and identified as Tax Map #58B-3-43. Mr. Trager purchased the property last year to be used for corporate offices and training of new staff for his coffee shops in Lynchburg and Charlottesville. It was planned that the corporate activities would be within the primary building; however, Mr. Trager and his family are now living in that dwelling. The offices will be located in the main building and the storage of coffee and the grinding process will be in the accessory building. VDOT has approved the entrance, pending the placement of signs for entrance and exit. No E & S Control Plan is required, and AEP currently provides electric service to the site. There is a deeded access for driveways.
Mr. Trager stated that the Lovingston location is convenient for Lynchburg and Charlottesville employees. The coffee will be processed on site and delivered to other locations approximately once a month by van. The primary dwelling has been restored.
The public hearing was opened.
“Bo” Delk of 173 Roseland Road encouraged the Planning Commission to approve the site plan so that Mr. Trager can start grinding his coffee.

Commissioner Harman made a motion to recommend approval of the site plan to the Board of Supervisors, as stated in the following resolution:
Planning Commission approves Site Plan #2007-004 submitted by Mr. William Trager of 486 Front Street, Lovingston, Virginia, Tax Map #58B-3-43, for a 40’ x 26’ building to house equipment for a coffee-grinding and processing business, contingent upon meeting VDOT’s requirements for one-way signage.
Commissioner Russell provided the second, and motion passed 6-0.
Site Plan #2007-005 – Nelson County Historical Society – “Oakland” Museum
Mr. Boger reported that Mr. Massie Saunders has submitted a site plan for the “Oakland” Museum located at 5365 Thomas Nelson Highway (portion of Tax Map #67-A-66) to make site improvements which include a temporary parking lot on the right side facing the building, a commercial entrance with tapered lanes on the highway, and signage.
Mr. Saunders stated that additional parking is needed for the general public and that handicap parking will be retained in the current parking lot. The parking lot will consist of 6” of compacted stone which could be paved in the future. No lighting is needed, and landscaping already exists. There are plans for future development of other historic-type buildings on this property.
The public hearing was opened, there were no comments, and public hearing was closed.
Commissioner Russell made a motion to approve the site plan, as stated in the following resolution:
The Planning Commission approves Site Plan #2007-005 submitted by the Nelson County Historical Society for the addition of an entrance from U. S. 29’s southbound lane, a 60’ x 90’ temporary parking lot, and signage promoting “Oakland Museum,” on property located on Thomas Nelson Highway, Colleen, a portion of Tax Map #67-A-66, as shown on site plan dated October 15, 2006 consisting of two pages.
Commissioner Harman provided the second, and motion passed 6-0.
Other Business
Mr. Boger distributed a rough draft of possible definitions and uses of Wine Tasting Rooms. There have been two applications received for this type of use and one of the applicants has asked that the zoning ordinance be amended to add these uses. The information is being presented to the Planning Commission as advance notice and preparation for next month’s meeting.

By right – A-1 District
Wine Tasting Room (Class I): A facility in which wine products grown or processed on the owner’s property may be tasted and sold. The facility must be operated in association with an existing vineyard (bona fide farm) located in Nelson County and on the same property, or multiple adjoining properties in the same ownership.
Special Use Permit – A-1 District
Wine Tasting Room (Class II): A facility located either on or off-site in which wine products may be tasted and sold. Accessory uses permitted with this facility include antique sales, craft and gift shop, the serving of light snacks (cheese, crackers, peanuts, etc.). The facility must be operated in association with an existing vineyard (bona fide farm) located in Nelson County.
Conditional Use Permit – A-1 District
Wine Tasting Room (Class III): A facility located either on or off site in which wine products may be tasted and sold. Accessory uses permitted with this facility include antique sales, craft and gift shop, meeting rooms, dining and catering facilities, and a restaurant. The facility must be operated in association with an existing vineyard (bona fide farm) located in Nelson County.
Mr. Massie Saunders reminded the Commission that the zoning ordinance requires that site plans be accompanied by a survey which would clearly determine conformance or nonconformance.

APPROVING
SITE PLAN #2007-004 FOR
WILLIAM TRAGER
WHEREAS, Mr. William Trager is requesting site plan approval for property located at 486 Front Street, Lovingston, Virginina, Tax Map #58B-3-43 for a 40’ x 26’ building which will house equipment for a coffee-grinding and processing business; and
WHEREAS, a notice of Public Hearing for the review of the site plan by the Nelson County Planning Commission was published in the Nelson County Times on February 8 and 15, 2007; and
WHEREAS, on February 12, 2007, adjoining property owners were notified of the public hearing on this application; and
WHEREAS, on February 28, 2007, the Nelson County Planning Commission held the required public hearing on said site plan; and
NOW, THEREFORE, BE IT RESOLVED BY THE NELSON COUNTY PLANNING COMMISSION as follows:
Planning Commission approves Site Plan #2007-004 submitted by Mr. William Trager of 486 Front Street, Lovingston, Virginia, Tax Map #58B-3-43, for a 40’ x 26’ building to house equipment for a coffee-grinding and processing business, contingent upon meeting VDOT’s requirements for one-way signage.

NELSON COUNTY HISTORICAL SOCIETY
WHEREAS, the Nelson County Historical Society is requesting site plan approval for the addition of an entrance from U. S. 29’s southbound lane, a 60’ x 90’ temporary parking lot, and signage promoting “Oakland Museum,” on property located on Thomas Nelson Highway, Colleen, a portion of Tax Map #67-A-66; and
WHEREAS, a notice of Public Hearing for the review of the site plan by the Nelson County Planning Commission was published in the Nelson County Times on February 8 and 15, 2007; and
WHEREAS, on February 12, 2007, adjoining property owners were notified of the public hearing on this site plan; and
WHEREAS, on February 28, 2007, the Nelson County Planning Commission held the required public hearing on said site plan; and
NOW, THEREFORE, BE IT RESOLVED BY THE NELSON COUNTY PLANNING COMMISSION as follows:
The Planning Commission approves Site Plan #2007-005 submitted by the Nelson County Historical Society for the addition of an entrance from U.
