Meeting Minutes
May 7, 2007

Members Present:      John Bradshaw, Kim Cash, Linda Russell, Gifford Childs, Goffrey Miles, and Ron Moyer, Alternate

Staff Present:    Fred M. Boger, Planning Director and Betty Fortune, Secretary

Call to Order:    Mr. Bradshaw called the meeting to order at 7:30 P.M. in the Board of Supervisors meeting room of the County Courthouse.      

Approval of Minutes:    Minutes of the March 5, 2007 BZA meeting were reviewed.  Mr. Childs made a motion to approve the minutes as submitted, Ms. Cash provided the second, and motion passed 5-0.

Variance #2007-004 – Arthur J. Palazzo

Mr. Boger reported that Mr. Palazzo is requesting a variance allowing placement of an 8’ x 10’ shed on his property prior to construction of the primary residential dwelling.  The property is located on Davis Creek Lane (Rt. 623) west of Perry Lane (Rt. 625), Tax Map #44-A-9E.  Mr. Palazzo was unable to attend the meeting due to business travel.

Mr. Childs noted that the Board is unable to place conditions on the variance at this time due to State regulations, i.e. length of time between building of the shed and the primary residence, that it not be used as living quarters, etc.  Pending zoning ordinance amendments would change this situation.  Mr. Childs felt this should be deferred until such time as conditions can be placed on the variance.  

Ms. Russell clarified the lot number as 9E.  The plat shows 4B, which was a number assigned by the surveyor rather than Commissioner of Revenue’s office.  Ms. Russell was in favor of deferring the decision to June 4 and sending the applicant a letter requesting the date construction is planned for the main dwelling, an accurate location of the shed, actual setbacks, etc.

Mr. Childs made a motion to defer this variance request to June 4, 2007.  Mr. Miles provided the second.

Ms. Russell reiterated that it should be explained to Mr. Palazzo in writing that the Board needs additional information, as stated above.

Motion passed 5-0.

There was no other business to be discussed.

At 7:55, Chair Bradshaw declared the meeting adjourned.
