NELSON COUNTY PLANNING COMMISSION
MEETING MINUTES
November 30, 2004 - 7:30 P. M.
Present: Mr. Thomas Bruguiere, Mr. Michael Harman, Mrs.
Philippa Proulx à Chair, Ms. Linda Russell, Dr. Valdrie Walker
Staff Present: Mr. Fred Boger and Mrs. Betty Fortune
Call to Order: Chair Proulx called to order the meeting which is
a continuation of the November 29, 2004 Planning Commission
meeting. She stated that the purpose of the meeting was to
review and make recommendations for revising the proposed zoning
ordinance in preparation for a public hearing and submission to the
Board of Supervisors.
Meeting Specifics: The Commissioners reviewed Chapters 3.E Ã 3.I,
taking into consideration the changes already made by Mr. Boger and the
ones proposed by Mrs. Proulx. A brief description of major items
follows, and all edits and changes are available for review in the
Planning office.
A) Rural and Farming District à Maximum Residential Density
Ms. Russell asked to revise her November 29 motion on this item to add ³not including residueÅ as shown below:
Minor subdivision à 1 dwelling unit per 5 acre lot with a maximum of 5 lots, not including residue.
Major subdivision à 1 dwelling unit per 10 acre lot
with a maximum of 5 lots or 1 dwelling unit per 20 acres with no limit
to the number of lots, not including residue.
B) Rural-Residential District à Maximum Rural Residential Density
Ms. Russell asked to revise her motion on this item to add ³not including residueÅ as shown below:
Minor subdivision à 1 dwelling unit per 3 acres with a maximum of 5 lots, not including residue.
Major subdivision à 1 dwelling per 5 acres, not including residue.
C) Business districts were discussed.
The County Attorney has indicated that a separate business district
should be created to avoid conflict of interest. The Board of
Supervisors wants to keep the present B-1 District as it is. Mr.
Boger was asked to develop and provide a draft for
an addition to the proposed ordinance. B-1 is the most
business-intensive district in
the County and must be preserved and expanded. The current B-1
and SE-1 Districts will be combined into the B-1 District.
D) The Landscaping chapter is being worked on by Mr. Boger.
E) Home occupations were addressed and additions/changes made in several chapters.
F) Village-Mixed Use (Nellysford)
The new maximum district size is 10 acres. Existing Mixed-Use parcels may be added to.
It was decided that the finished product (zoning ordinance draft) will
be needed by December 8 when the first Public Notice is published in
the Nelson County Times.
At 10:00 Ms. Russell made a motion to continue the meeting on December
1, 2004 at 6:30 P. M. Dr. Walker provided the second and the
motion carried 5-0.
