NELSON COUNTY PLANNING COMMISSION
MEETING MINUTES

November 29, 2004, 7:30 P. M.

Present:  Mr. Thomas Bruguiere, Mr. Michael Harman,  Mrs. Philippa Proulx ö Chair, Ms. Linda Russell, Dr. Valdrie Walker

Staff Present:  Mr. Fred Boger and Mrs. Betty Fortune

Call to Order:  Chair Proulx called to order the meeting which is a continuation of the November 17, 2004 Planning Commission meeting.  She stated that the purpose of the meeting was to review and make recommendations for revising the proposed zoning ordinance in preparation for a public hearing and submission of recommendations to the Board of Supervisors.

Meeting Specifics:  The Commissioners reviewed Chapters 1 ö 3.D, taking into consideration the changes already made by Mr. Boger and the ones proposed by Mrs. Proulx.  A brief description of major items follows, and all edits and changes are available for review in the Planning office.

A.    Rural and Farming District ö Maximum Residential Density
    Ms. Russell made a motion to revise this section to specify:
ð    Minor subdivision ö 1 dwelling unit per 5 acre lot with a maximum of 5 lots.
ð    Major subdivision ö 1 dwelling unit per 10 acre lot with a maximum of 5 lots OR 1 dwelling unit per 20 acres with no limit to the number of lots.
ð    Family subdivision ö 2 acres minimum.
        Dr. Walker provided the second and there were 4 ãYesä votes with Mr.             Bruguiere voting ãNo.ä

B.    Rural-Residential District ö Maximum Rural Residential Density
    Mr. Bruguiere felt this District should be removed altogether.  Mr. Boger     stated that doing so would eliminate the availability of smaller lots and Dr.     Walker felt this District met a need for compacted building in a rural area.      Mrs. Proulx stated that farming operations are challenged in denser areas.      A majority of the Commissioners agreed to keep the Rural-Residential     District as proposed.      Ms. Russell made a motion to revise this section of     the Ordinance to specify:
ð    Family subdivision ö 2 acres minimum.
ð    Minor subdivision ö 1 dwelling unit per 3 acres with a maximum of 5 lots.
ð    Major subdivision ö 1 dwelling unit per 5 acres.
Dr. Walker provided the second and there were 4 ãYesä votes with Mr. Bruguiere voting ãNo.ä

C.    Business districts were discussed.  Mr. Boger stated there is only 1 business of any size in the County ö most businesses are on individual lots.  There are three business districts now ö B-1, B-2, and Service Enterprise (SE-1).  B-2 contains only those businesses not addressed with B-1 zoning.  B-1 and SE-1 can be ãgrandfatheredä so they can develop according to the original ordinance.  

D.    The Landscaping chapter is being worked on by Mr. Boger.

E.    Chapter 10, Planning Commission, has been deleted since the rules and regulations are covered in the Code of Nelson County.

F.    Mr. Boger reviewed the document outlining concerns raised at the September joint BOS/PC/public meeting.

At 10:00 P. M., Ms. Russell made a motion to continue the meeting on November 30, 2004 at 7:30 P. M.  Dr. Walker provided the second and the motion carried 5-0.
