Meeting Minutes
June 6, 2005
Members Present: John Bradshaw, Kim Cash, Gifford Childs, Goffrey
Miles, Linda Russell, Ron Moyer, Alternate
Staff Present: Fred Boger, Betty Fortune
Call to Order: Mr. Bradshaw called the meeting to order at 7:30
P.M. in the Board of Supervisors meeting room of the
County
Courthouse.
Approval of Minutes: Minutes from May 2, 2005 were reviewed. Ms.
Cash made a motion to approve, Mr. Childs provided the second, Ms.
Russell abstained, and motion passed
4-0.
Variance #2005-010 Ã Elizabeth Mathias
Mr. Boger reported that Ms. Mathias has submitted a petition for
a variance to Section 2-2, Accessory use or structure, of the Countys
Zoning Ordinance to permit the placement/construction of a shed to
store tools and other items prior to the construction of the main
building on her property located on Dutch Creek Lane (Rt. 631), Tax Map
#59-A-19A. The following items need to be addressed:
á The shed cannot be located within the 100 year floodplain of Dutch Creek.
á The shed cannot be used for any residential purposes.
á A time period must be set for construction of the main building to commence.
á An erosion control plan may be required for construction of any new roads.
á A permit from the U. S.
Army Corps of Engineers and the State may be required for construction
of any bridge over a stream.
There may be a need for a permanent culvert in the private
driveway. The lot is not in the 100-year floodplain. The E&S
plan will be required as part of the building permit.
Ms. Mathias said the size of the building will be 12 x 18 and used to
store her bicycle, kayak, garden tools, etc. There is no
permanent dwelling on the property now; however, she plans to start
construction within the year. Her home in Charlottesville is for sale
at this time. The shed will be portable and bought as a packaged
shed from Capital Shed.
Ms. Cash stated that she felt a one-year building time-frame was
appropriate and if necessary, Ms. Mathias could apply for an
extension. Mr. Childs agreed. Ms. Cash then made a motion
to approve Variance #2005-010 to allow construction of a storage
building with the storage shed not being used for residential
purposes. Construction on the main dwelling is to begin within
one year. Mr. Miles provided the second. Ms. Cash amended
the motion to strike the word building and replace with shed. Mr.
Miles again provided the second and motion passed 5-0.
Variance #2005-008 Ã Tim Moss, Sr.
Mr. Moss was not present and after waiting a reasonable amount of
time, Ms. Russell made a motion to adjourn the meeting. Mr.
Bradshaw declared the meeting adjourned. The meeting was then
reopened in order to discuss disposition of the Moss variance. Mr.
Childs made a motion to postpone a decision on Mr. Mosss variance
request until the next meeting. Ms. Cash provided the
second. Ms. Russell asked that a site plan be provided before the
next meeting and that Mr. Lowes signature be obtained on the
application or an authorizing letter since the property is listed in
his name. Motion carried 5-0.
Mr. Bradshaw then declared the meeting adjourned.
